Binoy Kodiyeri refuses to take DNA test on paternity
THIRUVANANTHAPURAM: The Mumbai police on Friday approached a local court seeking DNA test on Binoy Kodiyeri in connection with case of rape and cheating registered by a woman in Oshiwara police station.
The police said DNA test was essential to carry forward the investigations into the case. For the DNA test to be conducted, the custody of Binoy who is the elder son of CPM state secretary Kodiyeri Balakrishnan, is mandatory. However, he has been evading arrest despite a notice being served by a two member Mumbai police team at his residence in Thalassery in Kannur district on Thursday.
Binoy’s lawyer contested the demand made by the police for DNA test in the anticipatory bail application moved in Dindoshi Sessions Court Mumbai on Friday. The court will deliver its verdict on the bail plea on Monday.
Binoy’s lawyer Ashok Gupta argued that the woman had raised similar baseless allegations against his client in the past. The complaints were made with the intention of extorting money. The claim made the complainant about her marriage is fake.
“In the FIR the woman says that she was not married. She is in fact claiming maintenance as the wife of the accused. If that is true that means her whole case in the first information report is false. Assuming for the sake of argument that suppose he had a relation that’s consensual then it is what we call relationship with consent only,” he added.
Binoy contested the demand for DNA test saying that such a test was not required in a sexual assault case. The accused said he was ready to cooperate with the investigations.
The prosecution objected to anticipatory bail plea contesting that the Binoy belongs to an influential political family and granting him bail could adversely affect the ongoing investigations.
With Binoy evading appearance before the investigation team of the Mumbai police, the Oshiwara police is planning to issue a lookout notice against him.
