Kerala High Court overturns PSC decision

The court observed that PSC which is a constitutional functionary cannot be permitted to act arbitrarily.

Kochi: The Kerala High Court has held that the recommendation of the state government and the decision of the PSC to confine the benefit of the extension to the rank lists which are not extended so far is arbitrary and unreasonable.

The court observed that PSC which is a constitutional functionary cannot be permitted to act arbitrarily.

It issued the order on the petition filed by N. Gopakumar of Neyyattinkara and 13 others challenging the decision denying the benefit of the extension of validity period to certain rank lists, citing those were once extended.

The petitioners were included on the list published in 2013 for appointment to the post of Mazdoor in the Kerala State Electricity Board.

The PSC had earlier extended the rank lists but excluded recently saying the extension will not be applicable to those ranked lists whose validity period have already been extended. According to the petitioners, the post of electricity worker/Mazdoor is one for which the educational qualification prescribed is the minimum, and several of the candidates included on the list have become over-aged.

They also said there was a ban on appointments on different occasions on account of elections.
