Telangana HC drops Enforcement Directorate case against IAS officers

He said it was mandatory to obtain sanction to take a case against these officials into cognizance.

Hyderabad: The Telangana High Court on Monday quashed the cases filed against senior IAS officers Adityanath Das and B.P. Acharya by the Enforcement Directorate in two chargesheets regarding the alleged illegal investments case of YSRC chief Y.S. Jagan Mohan Reddy.

Giving his order on separate petitions filed by the officers, Justice B. Siva Shankar Rao observed that the ED had not taken sanction from the competent authority before filing the cases. He said it was mandatory to obtain sanction to take a case against these officials into cognizance.

The judge said that the ED can file cases against the officers after obtaining permission according to the law which affords special protection to public servants.

The HC has postponed the implementation the order for four weeks to allow the ED to appeal before the SC. ED counsel had sought eight weeks to approach the apex court, saying the orders would affect all cases pending before ED special courts across the country.
