Chennai: Court extends its helping hand to HIV infected boy

The other requirements like food, clothing, travel expenses, educational expenses are to be met out by him and his parents.

Chennai: Noting the agony in the eyes of the 20-year-old victim boy, who was diagnosed HIV positive after blood transfusion at a government children hospital when he was 10 months old child, a city civil Court has said this court would be failing in its duty if this judgment is restricted to the relief claimed in the suit and suggested to the state government to provide him a job.

Decreeing the suit filed by S.Sorna, mother of the victim and awarding `20 lakh as compensation, XVII Additional City Civil Court judge V.Thenmozhe said, “Before parting with the case, this court would like to make certain observations. This court is aware that this court is not empowered to pass any directions to the defendant (Children Hospital in Egmore) or Government of Tamil Nadu regarding any other assistance or benefits to the victim boy. However, after seeing the agony in the eyes of the boy, who appeared before this court and on hearing his evidence in a feeble voice, this court would be failing in its duty if this judgment is restricted to the relief claimed in the suit”.

The humane judge said as per his evidence, the boy has studied Diploma in Auto Mobile Engineering. Appointing the boy in a government job and providing monthly income would definitely help the boy to live the rest of his life with some dignity. The said monetary benefit may help him to lead a life without any difficulty as to his livelihood. Being a son, he can also support his parents monetarily. A defence witness has stated in his evidence that the required medicines were given at free of cost. But mere supply of medicines at free of costs is not sufficient.

Therefore, this court would like to suggest the government of Tamil Nadu to consider his case as a special one and appoint him in any post suitable to hiseducational qualifications.

The office is directed to send the judgment of this case to the principal/chief secretary of government of Tamil Nadu and secretary to government of Tamil Nadu, health and family welfare Department. “This court reiterates that it is the wish of this court by considering the facts and circumstances of the case and it is the prerogative of the government in taking a decision in this regard”, the judge added.
