Hyderabad: Giving a shock to private builders who had allegedly constructed hundreds of flats at Gopalnagar Cooperative House Building Society Ltd, Hyder-nagar, Kukatpally, the Hyderabad High Court has issued an order banning the sale of flats besides staying further construction.
Justice A.V. Sesha Sai was dealing with petitions filed by Mr N. Srinivasa Rao, Mr S. Satyanarayana, Mr N. Satyanarayana and others challenging the action of the GHMC in interfering with the construction of about 60,000 sq. ft in different blocks in the society. The petitioners contended that their constructions were regularised in 2010 and the GHMC was demolishing their structures illegally.
GHMC counsel Sampath Prabhakar Reddy told the court that individuals had occupied government land using forged documents and raised huge structures without permission and the GHMC had demolished them.
Stating that the question of regularisation would arise only if structures were raised before 2015, he said that the petitioners were still raising structures and the certificates produced to claim regularisation were fake.
Mr Prabhakar Reddy said the petitioners had misled the court by quoting wrong survey numbers; the land on which the petitioners were calming rights was park land.
He told the court that the GHMC had suspended a town planning supervisor and transferred two assistant city planners for failing to prevent the illegal constructions by the petitioners.
Recording the statement, Justice Sesha Sai granted the interim order and posted the case for two weeks.
