Wrap-up: What is key? Religion or equality? SC will decide
In a decision that could have far-reaching consequences, the Supreme Court has said that a five-judge constitution bench will sit on May 11 to decide on pleas relating to aspects of the controversial triple talaq.
The bench will decide whether triple talaq and polygamy are protected under the fundamental right to religion guaranteed under Article 25 of the Constitution.
Apart this, the apex court bench would hear on whether the right to religion is subject to important fundamental rights like right to equality (Article 14) and right to life (Article 21).
It will also adjudicate if personal law can be termed as a law under Article 13 and if triple talaq and polygamy are compatible with India’s obligations under international treaties and covenants to which it is a signatory.
