Justice delayed for displaced, Telangana high court told
Hyderabad: Project-affected persons were deprived of justice and legal remedies after their lands were acquired for the Kaleshwaram and Palamuru-Ranga Reddy projects, counsels for the displaced told the Telangana High Court on Friday. They complained that state government was neither trying to resolve the issues of the victims nor was it answering in court the petitions filed by the victims for three years.
More than seven advocates came before the Green Bench comprising Justice A. Rajasheker Reddy and Justice P. Naveen Rao, which was constituted to deal with issues related to land acquisition for irrigation projects, and will function every Friday at 2.15 pm. They urging the bench to direct the government to pay the compensation and R&R package immediately to the project oustees.
Counsels appealed to the bench to vacate the stay orders issued by the vacation bench, headed by then acting Chief Justice R.S. Chauhan, who is now the Chief Justice. The vacation bench issued interim orders allowing the government to continue work on the irrigation project by directing that construction should not be stopped due to the pendency of the litigations filed by the oustees and affected families.
Counsels said that this interim order vacated all stay orders that were previously given in the victims’ favour, which restrained the authorities from dispossessing them until the liabilities paid under the Land Acquisition Act. Counsels said the victims did not have immediate remedy as the Green Bench functions only on Friday afternoons.
The bench asked the AAG why the oustees were approaching the court and why their petitions were pending for years.
