Madras High Court orders 1 PG medical seat to be left vacant for NRI

According to Dr Shwetha, she had completed her MBBS from a private medical college in Chennai in 2015.

Chennai: The Madras high court has directed the Selection Committee, Directorate of Medical Education to keep one seat vacant in PG medical courses for an NRI who had approached the court against the provisional eligibility list published by the selection committee.

A division bench comprising Justices R.Mahadevan and M.Govindaraj gave the directive on a petition filed by Dr S.Shwetha, a resident of Abu Dubai, UAE which sought to quash the provisional eligibility list published by the Selection Committee dated May 15, 2017 and to publish a fresh provisional eligibility list for admission to the PG degree/ diploma courses under NRI quota in Self financing medical colleges and deemed universities in the state.

According to Dr Shwetha, she had completed her MBBS from a private medical college in Chennai in 2015. She had also completed the CRRI (Compulsory Rotatory Residential Internship) on April 23, 2015. She was also given Permanent Medical Registration Certificate for practising the profession by Tamil Nadu Medical Council. She had appeared for Neet and secured 684.43 marks. In the meantime, she got married and started living with her husband in Abu Dubai from 2015. As she stayed there for more than 182 days, she got the status of NRI. NRI seats were available in self financing medical colleges and deemed universities.

Therefore, she applied separately for both the self financing colleges and deemed universities under management and NRI quotas. However, in the provisional eligibility list published by the Selection Committee, her name was not found, though she had the required qualification. Hence, she filed the present petition, she added.

Posting to June 2, further hearing of the case, the bench also directed the petitioner to produce all documentary evidences before the Selection Committee on May 23 and on verification, if the authorities were not satisfied with the same, they can file a counter affidavit. In its order, the bench said, “The counsel for the petitioner produced all the required documents along with the marks secured in Neet examination. The Special government pleader submitted that the petitioner did not fulfil the required conditions for PG degree under NRI quota. It is apparent on the face of the records that the petitioner secured higher marks and her opportunity for admission for the course has been denied. Hence, as an interim measure, there shall be an order of interim direction to the authorities to keep one seat vacant pending disposal of the petition”.
