Oommen Chandy questions solar report in Kerala High Court
KOCHI: Former Chief Minister Oommen Chandy on Monday has approached the Kerala High Court seeking the quashing of the Solar Commission Report by Justice G Sivarajan. The petition has also sought to annul the further procedures initiated by the state government based on the letter of Saritha Nair and also pleaded for ending all references to the defamatory contents in the letter. The court has posted the case for Tuesday. The petition has pointed out that the commission has based its conclusions solely on the letter of Saritha Nair.
The petition has also questioned findings and recommendations of the commission going beyond its terms of reference. The petition also contain a copy of the legal advise given by former Supreme Court Judge Arijit Pasayat in the matter. Congress leader and senior advocate Kapil Sibal is the counsel for Chandy. Former Chief Minister Oommen Chandy has stated that the fresh probe and measures ordered by the state government in the wake of the Solar Commission report is politically motivated. In a petition filed in the HC on Monday seeking the quashing of the Commission report, the former CM has also pleaded for media from publishing the content of the commission report and news reports based on it.
The petition has pointed out that the changes made by the commission in the terms of reference are unconstitutional. The letter by Saritha Nair is fake and all actions based on the letter should be annulled, the petition pointed out. Justice Shaji P Chali meanwhile has recused from hearing the petition of Chandy. High Court Chief Justice will decide the new bench hearing the petition. The former Chief Minister and Congress leaders in the state have been insisting that the Solar Commission has submitted a partisan report and the LDF government headed by Chief Minister Pinarayi Vijayan has been using the report for a political witch hunt.
