Hyderabad High Court dismisses plea against Telangana CEO
Hyderabad: Expressing disinclination to intervene into the affairs of the Election Commission in holding elections to the Telangana Assembly, the Hyderabad High Court on Tuesday dismissed a petition moved questioning the action of the Chief Electoral Officer (CEO) of Telangana in advancing the revision of poll schedule in the state. Mr. Kommireddy Krishna Vijay Azad an advocate of the city moved the plea stating that the action of the CEO appears to be influenced by the Chief Secretary of the state.
A division bench comprising Chief Justice Thottathil .B. Radhakrishnan and Justice V Ramasubramanian while dismissing the petition made it clear that it would not intervene in any decision of the EC as it has to complete the elections within 6 months from the date of dissolving of the assembly as per the Constitution.
The bench reminded that the poll revision was not only advanced for the election of Telangana, it was also advanced in the Rajasthan, Chhattisgarh, Madhya Pradesh and Mizoram where the general elections are in due. The bench also made it clear that the notification of the CEO was strictly in accordance with provisions of the Constitution and the petitioner failed to show any proof that the notification would not facilitate free and fair polls in the state. The bench refused the request of the petitioner to withdraw his plea.
