Hyderabad HC bars Lodha group from selling property in Kukatpally

Old bookings to be exempted, stay on agreements of sale.

Hyderabad: In a major setback to the Lodha group, the High Court on Monday ordered status quo on further construction and sale of Lodha Meridian property in Kukatpally.

Those who have purchased property there or paid an advance for it are exempt. All new bookings and agreements of sale where payment has not been made stand cancelled.

The Lodha group has been barred from selling any more property in Meridian or constructing further, till the further direction of the court.

The court has also stalled demolition of the wall demarcating Bellezza and Meridian, which the GHMC had called illegal. The residents of 150 sky villas of Bellezza had moved court on this matter.

Lodha Bellezza secretary Kalyan Reddy said, “The Lodha Bellezza Apartment Owners’ Welfare Association had filed a writ petition in the High Court following a notice by the GHMC which termed the wall built between the two buildings illegal.”

“The court has ordered status quo with regard to construction and the builder, Lodha Realty Construction & Developers Pvt Ltd, has been directed not to create any encumbrances. The court has stayed any further construction,” he said.

“The GHMC issued demolition notice to Lodha builders and not to the Bellezza residents’ association. We fear that if the wall is pulled down, the residents of the adjacent Meridian will be able to avail of our amenities. So we approached the court and got a stay on the demolition. The court also stayed further sale deeds, agreements of Lodha Ventures, till further court directions,” he added.

The dispute between the residents of the two complexes, Belleza and Meridian at Kukatpally, arose when Bellezza residents did not want to share their amenities with Meridian residents.

The builder constructed a wall separating the two complexes, following agreements that Bellezza and Meridian will have separate facilities.

However, the residents of Meridian approached the GHMC to demolish the wall as the builder had failed to provide them the amenities promised.

Since both ventures were approved on a single layout, the GHMC had issued a notice to demolish the wall.
