Hyderabad: The Hyderabad High Court has upheld the detention of promoters Dial Easy Network Pvt Ltd and Union Value Services Pvt Ltd, who cheated scores of innocent people by promising loans.
A division bench comprising of Justice C.V. Nagarjuna Reddy and Justice G. Shyam Prasad refused to quash the order of detention of Girish Kumar Makhija and a New Delhi-based woman and promoters of Dial Easy Network and Union Value Services.
The Hyderabad Police Commissioner has sent them to preventive detention following three cases booked against them by Hyderabad Cyber Crime Police station and one case in Kukatpally. They allegedly secured deposits from gullible persons by floating fake companies and promising loans and then duping them.
The police have registered cases against the duo for offences under Section 66(C) and (D) of the Information and Technology Act, 2008, and Sections 419 and 420 Sections 468, 471, 417, 419 and 420 of IPC.
The complainants alleged that they received frequent telephone calls from tele-callers claiming to be representatives of the companies, stating that they will provide loan of Rs 10 lakh on low rate of interest and insisted that they to take two insurance policies for the sanctioned loan amount with some amount paid towards processing fee, etc.
After believing it, they had taken insurance policies and paid between Rs 1.2 lakh and Rs 2.38 lakh. Following this, detenu no. 2 and his associates changed SIM cards of their staff and thereby delinked them from the complainants.
The detenus were arrested on November 20, 2015 and the police commissioner passed the detention order on December 28, 2015 directing the detenus to undergo preventive detention for 12 months. The detention order was confirmed by the Advisory Board.
The detenus challenged the orders of detention before the High Court. While dismissing petitions, the bench observed that there could be no doubt that the activities of the detenus, if proved, would certainly affect the public at large and disturb the even tempo of public life. This is said to be the first time in the country that the accused involved in cyber and cheating crimes have been sent for preventive detention.
