Hyderabad: New Municipal Act to test citizens’ honesty

Legislation allows self-certification of plots by owners.

Hyderabad: Barring the Greater Hyderabad Municipal Corporation, all corporations and urban local bodies can get building permission for Rs 1 for plots up to 75 square metres according to the new Municipal Act.

The state government has given the opportunity to self-certify plans for plots sizes ranging from 75 to 500 square metres after paying the relevant fee. In case, any variation is found during the audit, the commissioner will correct the assessment and levy and collect the actual tax, along with one-time penalty of 25 times for incorrect certification.

This apart, if there is a deviation from the original plan after the self assessment the plot-owners along with the certified architect will liable for three years imprisonment and will be fined with 25 per cent of the registration fee.

The crucial decision taken by the government is it has not allowed the town planning officials for according permissions rather the job has been assigned to engineers from the panchayat raj and roads and buildings department and collectors.

A senior official said that in new Municipal Act the government had almost eradicated the official interference to completely eradicate the corruption.

He said to further curb the possibility of corruption, town planning officials have restricted to planning and limited powers pertaining to permissions were given to engineers from the panchayat raj and roads and buildings department or the collector.

“Municipal services will be delivered online for the convenience of citizens in a time-bound manner as per the citizens charter. If the timeline is not adhered to, penalty as prescribed will be recovered from the person responsible for the delay,” he said.

According to highly placed sources in the municipal administration department, owners of plot sizes ranging between 75 and 500 sq. m. can get instant online approval and can self-certify the property tax assessment.

Permission applications for all the individual residential buildings having a plot area of 500 sq.m. and less and building height of 10 metres as specified can be processed through an online based self-certification system in accordance with the master plan or detailed planning scheme or local area plan and the building rules and in the manner prescribed, and upon furnishing all required information details can get instant online approval.

Sources said for non-high rise buildings constructed in plots sized between 200 and 500 sq.m., the occupancy certificate will be issued online based on the self-certification and attested by the architect that the building is in accordance with the rules.

The onus to ensure authenticity of self-certification and compliance with the rules lies with the applicant, who could be held personally accountable and liable in case of false declaration. The government will undertake random audits of self-assessments. If there are deviations, the architect will be liable for three years imprisonment and face cancellation of licence. A 25 per cent of the registration fee will be also collected as penal amount.

A senior official said that the applications for layouts will be processed through the self-certification system and must stick to the master plan or detailed planning scheme or local area plan.

Once all documents are submitted and fee is paid online, the tentative layout will be approved automatically and this would be communicated online in order to carry out the infrastructure activities and provision of amenities in the defined time frame.

Building owners should submit approved layout/ LRS proceedings/ previous sanctioned plan, sale deed/ ownership document/ link documents, latest market value certificate if the proposal is not covered with approved layout/ previous permissions, latest encumbrance certificate, Auto CAD drawings in pre-DCR format by certified architect, license copy of architect, up to date property tax receipt, land use certificate, etc.
