Hyderabad High Court asks for executive council at Kakatiya University

Hyderabad: The Hyderabad High Court has directed the Telangana government and the Kakatiya University to take immediate steps for constitution of proper executive council to the varsity.

The court told the state government to first wake up to the fact that it cannot allow the Kakatiya University, a prestigious and renowned institution of learning, to be run with an improper executive council at its helm and take steps accordingly.

A division bench comprising Justice P.V. Sanjay Kumar and Justice M. Ganga Rao while dismissing an appeal by the varsity challenging an order of single judge in annulling the decision of the executive council in resolving to cancel the notification issued in 2012 for the appointment of assistant professors based on recommendations of the three-man committee constituted by the state government.

While setting aside the resolution of the executive council, the judge held that the university cannot act on the dictates of the government and the resolution passed by the university is not an independent decision of the university.

Finding that the existing executive council was not properly constituted, the judge directed the state government and the varsity on December 19, 2017 to constitute the council in accordance with Section 18 of the Andhra Pradesh Universities Act, 1991, within a period of three months.

The bench pointed out that the Government unilaterally directed the State Council of Higher Education to cause an enquiry and the state council, in turn, constituted a committee to enquire into the complaints.”

The bench made it clear that the government cannot force such recommendations upon the University.
