Give land for Metro rail project: Hyderabad HC

Transstroy must give up property by April 15.

Hyderabad: The Hyderabad High Court has directed Transstroy India Ltd to hand over possession of its building and land located in Jubilee Hills to the land acquisition authorities of Hyderabad Metro Rail Ltd by April 15, 2016.

A division bench, comprising Acting Chief Justice Dilip B. Bhosale and Justice P. Naveen Rao was dismissing a writ appeal by Transstroy challenging an order of the single judge declaring that the company cannot stall the metro rail project any more.

The company told the court that it had built a one-lakh sq. ft. building in Jubilee Hills on 2,000 sq. yd of land. Pointing out that the authorities were acquiring only 1,000 sq. yd. of the total area, the company said that this would render useless the remaining portion of the building and land.

The company contended that finalising the compensation under the old Land Acquisition Act even after the inception of the New Land Acquisition Act was illegal.

K. Vivek Reddy, counsel for the Land Acquisition Officer, told the court that the company was not furnishing its bank account number to them to deposit the compensation.

Maintaining that the company should take the compensation that is being given now, the bench said if it wants an enhanced compensation, it should approach a competent court.

No change in ex-MLA’s security
Justice P.V. Sanjay Kumar of the Hyderabad High Court has directed the AP police to continue with the existing security provided to former minister Dharmana Prasada Rao.

The judge granted the interim order while dealing with a petition by Mr Prasada Rao, challenging the withdrawal of his security cover (1+1 armed security guards) to him. He told the court that his security cover was withdrawn without prior notice.

Counsel appearing for the AP government said that the security cover was provided whenever there was a genuine threat perception. The state-level security review committee, after taking into consideration the threat perception reports, felt the need for withdrawal of existing security to the petitioner, counsel said.

After noticing that no notice was issued to the petition prior to withdrawal of security to him, the judge directed the police to continue the security cover to Mr Prasada Rao. Adjourning the case to March 3, the judge issued notices to the respondent authorities.

Panel looking into Kapu quota, says AP
The AP government has informed the Hyderabad High Court that it has constituted a commission headed by retired judge Justice Manjunatha to conduct and inquiry for inclusion of Kapu, Telaga, Balija and Ontari communities in the list of Backward Classes.

Justice P.V. Sanjay Kumar was hearing a petition by Kapu Reservation Porata Samiti chairman K.V.K. Rao and Ch. Venkata Rayudu of West Godavari district, seeking to declare as arbitrary and illegal the failure of the authorities to conduct an inquiry for inclusion of their communities in the list of Backward Classes in terms of Sections 9, 10 and 11 of the AP Commission for Backward Classes Act.

The petitioners said that Kapu, Balija, Telaga and Ontari communities were grouped as one class under broad category of Telaga and were included in backward communities list in 1915 and were continued as Backward Classes from 1915 to 1956.

When the AP government told the bench that it has already constituted the commission, the judge told counsel for AP to file an affidavit explaining the steps being taken in this regard and adjourned the hearing.
