Karnataka High Court notice on 'Parliamentary Secretaries' appointments

The petitioner contends that the state government enacted the Act in 1963 and amended it in 1999.

Bengaluru: The Karnataka High Court on Friday ordered issue of notice in the matter pertaining to PIL filed challenging the appointment of MLAs and MLCs as Parliamentary Secretaries.

The state government on January 7 issued a gazette notification appointing eight members from the both the state legislative houses as Parliamentary Secretaries.

The PIL filed by M.B. Adinarayana, has challenged the appointment on the ground that Karnataka Parliamentary Secretaries Allowances Act 1963 as unconstitutional.

He seeks directions to declare the appointment of eight people to the posts as invalid.

The petitioner contends that the state government enacted the Act in 1963 and amended it in 1999. He said that the appointments are unconstitutional under the Act and is also contrary to Article 164 (1-A) of the Constitution.

The eight whose appointment as parliamentary secretaries has been challenged are – K. Abdul Jabbar (MLC), Dr Anjali Hemanth Nimbalkar (MLA), Ivan D’Souza (MLC), Koujalgi Mahantesh Shivananda (MLA), Roopakala M Shashidhar (MLA), K. Govindraj (MLC), Raghavendra Basavaraj Hitnal (MLA) and DS Hoolageri (MLA).

The petitioner has sought for directions to declare the Karnataka Parliamentary Secretaries Allowances Act 1963 and the Amended Act 7 of 1999 as ultra vires.

The court has ordered to post the matter after serving notice in the matter.
