Hyderabad High Court: Consent needed to acquire land

The Hyderabad High Court on Thursday made it clear that authorities can enter into agreements with landowners.

Hyderabad: The Hyderabad High Court on Thursday made it clear that authorities can enter into agreements with landowners under Section 30-A of the Telangana State Land Acquisition Rules 2017 only while acquiring land by consent for Kondapochammsagar, which is part of the Kaleswaram lift irrigation scheme.

A division bench comprising Chief Justice Ramesh Ranganathan and Justice Uma Devi while disposing of a petition by Mr Srinivas and six farmers of Mamidyal in Siddipet district upheld the power of the government to acquire land by negotiations under the amended Act. The petitioners said that as per the new rules the collector cannot take agreement under forms meant for Section 23-A of Land Acquisition Act 2013 before the final declaration under relevant section was published. The bench said that the authorities will take the consent in appropriate forms only.
