Hyderabad High Court stays notice on acquisition
Hyderabad: The Hyderabad High Court on Wednesday stayed a notice under Section 4A of the Board Standing Order issued by tahsildar of Kandukur mandal to acquire about 493 acres to establish the Green Pharma City project at Meerkhanpet village in Ranga Reddy district. Justice M.S. Ramachandra Rao granted stay while dealing with a petition by Maddi Bharathamma and 16 others of the district seeking to declare the “A1 Notice” issued by the tahsildar notifying 493 acres for allotting the to the TS Industrial Infrastructure Corporation, as illegal.
The petitioners also challenged GO 45 issued on July 22, 2015 permitting the TSIIC to purchase lands through private negotiations wherever possible and to determine the valuation of the proposed to be acquired under private negotiation. The petitioners contended that the GO 45 was contrary to provisions of the Land Acquisition, Rehabilitation and Resettlement Act, 2013. N.S. Arjun Kumar, counsel appearing for the petitioner, told the court that the authorities were resorting to forcible acquisition of lands in the name of negotiations with farmers. He urged the court to direct them not to pressurise the petitioner.
Counsel appearing for revenue department submitted that the tahsildar issued the general notice to receive objections with regard to land acquisition from willing owners. While staying the notice for 8 weeks, the judge directed the respondent authorities to file a counter-affidavit. He posted the case after two weeks.
