No court jurisdiction on solar commission report
Kochi: The court has no jurisdiction to intervene over the content of the Solar Commission report even if it has errors, the state’s counsel submitted before the High Court during a special sitting on Saturday. The report has been placed on the table of the Assembly, and it is its property, he argued opposing former chief minister Oommen Chandy’s plea, and hence the court could not intervene, except for procedural lapses.
The court asked the government how a letter purportedly written by Saritha Nair and the sexual exploitation allegations, originally not part of the terms of reference of the commission, came to the consideration of the commission. The letter was not part of the terms of reference even after the commission revised them on its own, the court said. It also observed that repeated discussions on the content of the letter would adversely impact the image of the complainants. The hearing of others in the solar case including that of Nair will be held on April 7.
