Some relief for Mallannasagar oustees.

Hyderabad: The TS government on Wednesday assured the Hyderabad High Court that it will pay Rs 12.5 lakh to each family of artisans, landless poor and agriculture labourers affected due to land acquisition for the Mallannasagar irrigation projects in Medak district through GO 123.

TS advocate-general K. Ramakrishna Reddy gave the assurance while placing the data with regard to artisans, agriculture labourers and landless poor affected in six villages under Mallannasagar reservoir in Medak district, before a division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice U. Durga Prasad Rao.

The bench, while hearing a batch of petitions moved by landowners from Medak and Mahbubnagar districts challenging the procurement of lands by the government through GO 123, had on Tuesday asked the A-G to place data of people affected due to acquisition of land for irrigation projects.

The A-G told the court that there were 194 people in six villages who are landless, artisans, and agriculture labourers. He said that the authorities have been enquiring with regard to the number of such people who will be affected by the Ranga Reddy and Palamuru Lift Irrigation Schemes, and after completion of enquiry, he will place the data before the court.

Vedula Venkata Ramana and A. Satya Prasad, Senior counsels appearing for the petitioners, while objecting to the data submitted by the A-G, urged the court to seek details of National Rural Employment Guarantee Scheme to ascertain the actual number of people affected by the Mallannasagar project.

When the bench asked the A-G whether he had any details of the people who migrated from the six villages for livelihood, Mr Reddy replied in the negative.

The bench pointed out that the state government has assured the compensation to the people affected by the National Infrastructure and Investment Zone at Medak, under Schedule 2 of the Central Land Acquisition act 2013.

The bench asked the A-G to file an affidavit explaining the steps being taken to resettle, rehabilitate and compensate the affected families under irrigation projects under Schedule 3 of the Act, 2013, by November 23.

Nampally property owners to be paid under Land Act 2013
The Hyderabad High Court on Wednesday directed the TS government to pay compensation to owners of properties located on the Nampally stretch of the Hyderabad Metro Rail under the Land Acquisition Act, 2013.

A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice M. Satyanarayana Murthy, while pronouncing the orders in a batch of petitions challenging the awards passed under the earlier Land Acquisition Act, directed the authorities to pay the petitioners compensation under the new Act.

The petitioners told the court their lands and properties were acquired by the government for the Metro Rail in 2015, but the compensation award was passed with an ante date of January 1, 2014. The bench, after perusing the records, noted that the award was passed on December 23, 2013.

The bench held that since the authorities could not pay the compensation to all the property losers by the time the new Act came into force, they should now pay compensation to all the petitioners in tune with the new Act.
