Telangana to continue with part-time instructors: Hyderabad High Court

The judge said in view of the statutory provision contained in the RTE Act.

Hyderabad: The Hyderabad High Court has directed the TS government to continue with part-time instructors working in various schools run by the TS Sarva Shiksha Abhiyan till further orders.

Justice A. Ramalingeswara Rao granted the interim orders while dealing with petitions by K. Shobha and 17 others challenging the refusal of the SSA project director to re-engage them into service even after reopening of the schools for the academic year 2016-2017.

The petitioners urged the court to direct the project director to continue them as part-time instructors in their respective schools duly paying the salaries with effect from the re-opening of the schools.

The judge said, “It is the case of the petitioners that their services be continued as per the provisions of the Right to Education Act, but due to some unknown reasons no orders are passed.”

The judge said in view of the statutory provision contained in the RTE Act, there shall be a direction to continue the petitioners until further orders subject to the Rules applicable to the post.

Acting Chief Justice Ramesh Ranganathan of the Hyderabad High Court on Tuesday made it clear that the court will take-up petitions moved by the parties affected due to the land procurement for irrigation projects and not entertain pleas moved with political interests.

When the bench, headed by the ACJ, was hearing an appeal by the TS government against the GO 123 issued for procurement of land for irrigation and infrastructure projects by TS, counsel appearing for the petitioners requested taking up hearing of their petitions.

Justice Ranganathan replied that in view of the assurance given by the advocate-general on behalf of the state government that it will not touch the lands of the petitioners who have approached the High Court challenging procurement of lands for Mallannasagar project, their cases will be heard next week.

The ACJ said that a detailed hearing will be given to the affected landowners as there are larger public interests involved and no petition with political motives will be entertained.
