Roshan Baig moves Karnataka HC against SIT detention

The court has issued notice to state government and SIT and adjourned the matter to July 30.

Bengaluru: In a dramatic turn of events, Shivajinagar MLA Roshan Baig, who was detained by the Special Investigation Team (SIT) probing the IMA ponzi scam, has moved the Karnataka High Court. He has stated that taking him captive was illegal and seriously hampers his fundamental rights.

The court has issued notice to state government and SIT and adjourned the matter to July 30.

In his petition Mr Baig has stated that neither he is an accused nor being probed in the IMA case. “The petitioner was called to depose in the case as a witness under the Sec 160 of Cr PC. By a specific note, he was asked to come on July 19 at the SIT office. However, the investigators have acted malevolently.

They have forcibly taken him to SIT office from the airport, without any legally sustainable basis," the petition stated.

The petitioner is being undermined and distressed by the SIT at the instance of the ruling government to snatch his democratic rights by using an unconnected case.

Chief Minister H.D. Kumaraswamy has tweeted referring that the petitioner being taken by the SIT, which is a clear proof of unseen forces playing in the background by misusing the law enforcement machinery, it added.

Mr Kumaraswamy had tweeted that Mr Baig was flying to Mumbai and BJP state chief B.S. Yeddyurappa's personal assistant Santhosh was accompanying him when SIT detained him. The BJP has rejected the allegation.
