Defamation charges on BJYM leader

Following the complaint, the accused was questioned and he confessed to having committed the offence.

Hyderabad: A Bharatiya Janata Yuva Morcha (BJYM) leader from Secunderabad was arrested by the Neredmet police on charges of defamation and criminal intimidation, for posting abusive messages against Malkajgiri MLA Mynampally Hanumanth Rao on social media, following a complaint from the MLA’s supporters.

According to the Neredmet police, a complaint was received from one Sira Rohit, a TRS activist from Madhuranagar, who stated that Pampari Sai Prasad, 29, from Secunderabad and others had posted a video on social media, threatening Mr Rao by using abusive words.

Following the complaint, the accused was questioned and he confessed to having committed the offence. A case was registered against him under Sections 500 and 506 of IPC and Section 66 A (b) of IT Act, and he was produced before the court.

It may be noted that the Supreme Court has struck down Section 66 A of IT Act in 2015 after it found that the section invaded Right to Speech.

Neredmet inspector A. Narsimha Swamy said, “A case was booked against the accused based on the complaint and he was produced before the court for judicial remand.

The section under the IT Act was invoked based on the complaint. After taking legal opinion, the Sections of the case will be altered if necessary.” Meanwhile, Rachakonda police commissioner also ordered an enquiry as to why the Sections were invoked in the case.
