Madras HC dismisses pleas from TTV Dhinakaran
Chennai: The Madras high court has dismissed the petitions filed by AMMK leader T.T.V.Dhinakaran challenging the re-opening of the assessment proceedings for the years 1995-96 and 1996-97 by the Income Tax department.
Justice S. M. Subramaniam said this court does not want to go into the merits and demerits of the case and if the court adjudicates the same, it would only cause prejudice to the investigation.The judge said it is an admitted fact that searches were made by the Enforcement Directorate and some materials were seized. It was alleged that the amounts invested in foreign countries had not been disclosed and cases were already registered under FERA on the basis of which the assessments were re-opened. Therefore, it would be premature for the court to go into the merits of the case, judge added.The judge directed Dhinakaran to approach the Income Tax authorities for giving explanations with regard to the seized materials. The IT department was also directed to afford an opportunity to him to explain so that the long pending litigation gets its logical conclusion, judge added.
