Chennai: Parcel service co to pay Rs 21,000 for misplacing order 7 years ago

In the reply, the manager stated that even after booking the parcel on January 23, 2012, Mohammed Ismail had kept silent till the end of May 2012.

Chennai: The District Consumer Disputes Redressal Forum, Chennai (South), directed a famous parcel service in the city to pay compensation of Rs 21,000 to a person for misplacing his parcel. He had sent a dining table and two chairs through K.P.N. Speed Parcel Service Pvt. Ltd., Guindy, seven years ago.

In the petition, S. Mohammed Ismail of Velacherry submitted that he planned to send a dining table and two chairs to his father-in-law residing in Mettupalayam. He purchased these for Rs 6,800 from Ram Sons Bedding Mart at Alandur. He booked a parcel containing a dining table and two chairs through K.P.N. Speed Parcel Service Pvt. Ltd., Guindy on January 23, 2012. The parcel did not reach the destination at Mettupalayam. Initially, the parcel service replied that they were searching for the consignment. Subsequently, there was no response from them. He issued a notice on May 28, 2012, to the manager of the company.

He said that the act of the company had caused him great mental agony. Hence, he filed the petition, seeking a direction to the company to pay him compensation along with refund of Rs 6,800 paid towards purchasing the furniture.

In the reply, the manager stated that even after booking the parcel on January 23, 2012, Mohammed Ismail had kept silent till the end of May 2012. As per the terms and conditions, the parcel shall be taken delivery of within two weeks. But the complainant did not claim the parcel for a long time.

Therefore the company had not committed any deficiency in service and the complaint was liable to be dismissed, the manager said.

The bench comprising president M. Mony, members K. Amala and R. Baskarkumaravel submitted that considering the facts and circumstances, the forum was of the view that the opposite party shall pay Rs 6,800, the value of the parcel and a sum of Rs 240, registration charges along with a compensation of Rs 10,000 and costs of Rs 5,000.
