Why not arrest Bijimol, asks Kerala High Court

Bijimol allegedly had attacked the Idukki ADM on July 4, 2015 during a demonstration.

Kochi: Kerala High Court on Monday criticised the investigating officer who filed a report that the arrest of Bijimol MLA was not needed in the case of the assault on the Idukki ADM. The court observed that the investigating officer was more loyal than the king. Bijimol allegedly had attacked the Idukki ADM on July 4, 2015 during a demonstration.

Rejecting a statement filed by the police, the court observed, “when an accused in a case of serious nature had appeared before the police, it is very strange to note that the police had not arrested the accused. The reasons mentioned by the police for not placing the accused under arrest, even when she was present before him, are not cogent and convincing. The reasons are illegal and the statement is rejected,” it said.

Justice B.Kemal Pasha criticised the police on a plea filed by Idukki ADM Moncy P. Alexander seeking the Crime Branch to complete the investigation expeditiously and to submit the final report before the court. The court criticised Crime Branch DySP M. Johnson Joseph and observed that the investigating officer was more loyal than the king.

The court observed that the sections registered against Biji Mol were serious and the offence attract an imprisonment for a term which may extend up to 10 years.

The statement does not show that the accused was interrogated by the police but the police categorically stated that the accused appeared and the statement was recorded, it said.
