Supreme Court fiat on adoption law passed by Parliament

The Act provides for adoption and punishments for not complying with the laid down procedure.

New Delhi: Observing that the new law passed by Parliament must ensure a credible mechanism for intra and inter-country adoption of children, the Supreme Court on Monday disposed of a PIL filed in 2012 seeking a law for adoption.

A three-judge Bench of Chief Justice T.S. Thakur and justices Ms. R. Banumathi and Uday Lalit asked the Centre to expeditiously frame guidelines and rules under the Juvenile Justice (Care and Protection of Children) Act, 2015 to facilitate adoption of children.

Earlier Additional Solicitor General Pinky Anand informed the court that to streamline adoption procedures for orphan, abandoned and surrendered children, the existing Central Adoption Resource Authority (CARA) has been given the status of a statutory body to enable it to perform its function more effectively.

The Act provides for adoption and punishments for not complying with the laid down procedure. Processes have been streamlined with timelines for both in-country and inter-country adoption including declaring a child legally free for adoption.
