Disproportionate assets case: Correcting the mathematical error

The Karnataka HC had said that the percentage of disproportionate assets was just 8.12 per cent.

BENAGLURU: One of the most-talked-about “mathematical errors” in the judicial history, it had resulted in the acquittal of former Tamil Nadu CM J. Jayalalithaa, present AIADMK general secretary Sasikala and two others, who were allegedly involved in the disproportionate assets case.

The Karnataka HC had said that the percentage of disproportionate assets was just 8.12%, which was within the permissible limit, and acquitted all the accused. Then Special Public Prosecutor B.V. Acharya had drawn attention to the faulty calculation made by the high court, and said that the error alone was sufficient to go on appeal before the Supreme Court. Now, after almost two years, it proved to be a major ground for the Supreme Court to uphold the trial court judgement convicting the accused in the DA case. Mr Acharya, senior counsel appearing on behalf of state of Karnataka before the SC, had contended that if the final figures arrived at by the Karnataka HC are accepted and apparent errors, including the calculation and arithmetical mistakes are corrected, the disproportionate assets will be more than Rs 35 crore and this alone is sufficient to sustain the conviction.
