Hyderabad High Court dismisses case againt TRS MLC
Hyderabad: The Hyderabad High Court has dismissed a petition seeking a direction to the Election Commission to take action against TRS MLC Mynampally Hanumantha Rao for filing false affidavits with regard to his educational qualifications submitted during the elections held in 2009, 2014 and 2017.
Mr P.M. Sai Prasad, a resident of Secunderabad, had moved the petitions, stating that Mr Rao had declared in his 2009 and 2014 affidavits that he has completed his BBA in the US. In his affidavit for the MLC election in 2017, he had declared that he had passed his Intermediate.
The petitioner told the court that he submitted a representation to the EC on March 17 seeking action against the MLC under Section 125-A of the Representation of People Act, 1951.
A division bench comprising acting Chief Justice Ramesh Ranga-nathan and Justice Shameem Akhter while dismissing the petition referred to a circular issued by the EC with regard to Section 125-A of the RP Act.
In the circular the EC had made it clear that it was open to any aggrieved party to move a petition before an appropriate court to take action under Section 125-A.
The bench refused to take up the petition but said the petitioner could avail legal remedies under Section 125-A of the Act.
