Hyderabad: Builders flash permits and NoCs over encroachment of lake lands
Hyderabad: The joint inspection report pointing to encroachment of lake land could lead to legal complications as the builders claim that they constructed only after getting clearances and no-objection certificates from the irrigation and revenue department and permission from the local panchyat and the HMDA. The report filed with the NGT states that in Vanam Cheruvu, a building housing Balaji Bar and Restaurant was constructed in the full tank level and buffer zone. The Tellapur gram panchayat executive officer said the unauthorised construction came up long back, and no approval was issued either by the gram panchayat or the HMDA.
Several rice mills have encroached on the full tank level of the lake. In Mella Cheruvu, the report said, there were 14 constructions with basement and pillars belonging to Nivee Property Developers Private Limited. The compound wall of Sankalp Homes falls in the buffer zone. The Aliens Space Station 30-floor building and incomplete cellar sits on Mella Cheruvu land.
HMDA commissioner T. Chiranjeevulu said a land grabbing case against Alien Developers was disposed of in 2014 where it was ruled that certain survey numbers in question were patta land and did not fall under the FTL. Regarding Nivee Properties, the HMDA said that the layout was approved based on the NoC of the irrigation department in 2006. It said its earlier survey found that the survey numbers were not in the submergence area, and were located above the full tank level.
Regarding the Sankalp Welfare Association building, the revenue and irrigation departments had fixed the FTL and based on which the Tellapur gram panchayat had issued building permission. In Chelikunta lake in Osmannagar, the HMDA report said a 14-floor apartment, the compound wall of Indus Crest, a multi-storey apartment of NCC and cellar of the Software Engineers Welfare Association.
The builders of these three constructions had obtained the NoC from the irrigation department. The HMDA said in the report on Ganganikunta that Vodka SSPDL and Vision Avenues were granted technical permission based on NoCs. HMDA said as per physical inspection Mega Meadows had closed and levelled a 76-metre channel at Chelikunta. It said Bonsai Homes has constructed concrete structures for two channels at Vanam Cheruvu.
Ramachandrapuram mandal tahsildar K. Mahipal Reddy, in his counter affidavit submitted to the NGT, said that the Mella Cheruvu irrigation channel was closed and levelled by Imami Constructions for a distance of 143 metres, and Pradeep Constructions to a distance of 80 metres. “It is noticed that 80 per cent of ayacut of Mella Cheruvu is converted for non-agricultural purposes. The physical inspections of Shiponi Vodka revealed that parts of the premises is encroached. Local inquiry revealed that Myfair Ventures and Vasudeva Constructions were responsible for the encroachments. He said the SSPDL project at Ganganikunta, Rajapushpa Properties and Vision Infinity Homes had obtained NoCs from the irrigation department.
