Chennai: The Madras High Court has stayed government circular dated August 24, 2017 directing the registering authorities not to register a vehicle to a purchaser who does not hold a valid driving license. Justice M. Duraiswamy, before whom a petition filed by the Federation of Automobile Dealers Association came up for hearing, passed the interim order.
The Association stated that the Transport Commissioner issued a circular to all Zonal Officers, All Motor Vehicles Inspectors of Unit offices in Tamil Nadu in a letter dated August 24 with directions not to register a vehicle if the purchaser does not hold a valid driving licence.
The notification was issued taking into consideration the increase in the number of accidents in the State and to control and prevent such road accidents. “The circular is not sustainable in law and arbitrary" the association pleaded and sought to set aside the circular”.
