Hyderabad HC grants interim stay on GO modifying scheduled caste list
Hyderabad: The Hyderabad High Court has come to the rescue of a girl belonging to SC community by granting interim stay on GO No. 2, dated January 22, 2015 for adaptation of the AP (SC, ST and BC) Regulation of Issue of Community Certificates Act, 1993 and AP (SC, ST and BC) Issue of Community, Nativity and Date of Birth Certificate Rules, 1997.
Justice Suresh Kumar Kait was dealing with a petition by Ch. Vimala Priya, an aspirant for the post of police sub inspector challenging a memo issued by the TS Police Recruitment Board rejecting her candidature for the post for not producing the caste certificate, as illegal.
The judge directed the Board chairman to allow Ms Priya to take the physical measurements test and physical efficiency test. Ms Priya brought to the notice of the court that she belongs to SC community and was born in Telangana and also completed her engineering in Hyderabad.
She submitted that her father was an assistant reserve sub inspector and though he was a native of Vizianagaram of AP, he migrated to Telangana in 1982 and had been working in Telangana since then.
When her father sought a caste certificate for her, he was told to apply at his native place. He subsequently obtained the certificate from AP. Ms Priya’s counsel contended that she belongs to Godagali caste, which was deleted from the SC through a GO on January 22, 2015. He said this was illegal and ultra vires to Article 341 (1) of the Constitution.
Market panel told to pay land tax
The Hyderabad High Court on Friday directed the Chairman and Secretary of Agricultural Market Committee at Bhainsa in Adilabad to pay '3.68 crore to the municipality as arrears of the vacant land tax.
Justice M.S. Ramachandra Rao granted the order while dealing with a petition by the Bhainsa Municipal Council seeking to declare the non-payment of arrears of vacant land tax to the Council as illegal.
Senior counsel A. Sudarshan Reddy, appearing for the petitioner municipality, pointed out that the respondent committee has loaned Rs 8 crore to agricultural marketing committee of Siddipet instead of paying the statutory dues to the municipal council of Bhainsa. He urged the court to direct the respondent to first clear the arrears payable to the petitioner.
Expressing wonder at the attitude of the marketing committee, the judge directed the authorities of TS agricultural marketing committee to clear the arrears of vacant land tax.
NTR health varsity asked to release certificates
Expressing concerned over parents rushing to have their wards admitted to medical courses somehow or the other, the Hyderabad High Court on Friday directed the NTR Health university to release the original education certificates of two MBBS students.
A division bench comprising Justice V. Ramasubramanian and Justice Anis passed the order after hearing pleas by T. Mani Deepa of Ranga Reddy district and C. Apoorva Raj of Warangal district who secured MBBS seats in AP in 2015.
The allegation against both the students was that they produced false study certificates which defined them as local candidates under SV University in Tirupati. Following an inquiry, the varsity refused to release their original certificates citing the police case against them.
They then approached the court seeking a direction for releasing of their certificates. Allowing the pleas, Justice Ramasubramanian said, “Both are unfortunate victims of the mad rush of parents to have their wards admitted to medical courses, somehow or the other. They are the products of avarice on the part of the parents.”
