Madras HC slams CMDA for not reining in illegal constructions

Stating that day by day the encroachments and illegal constructions are increasing the bench said that the object of creation of CMDA itself failed.

Chennai: The Madras high court has observed that if Chennai Metropolitan Development Authority (CMDA) is unable to stop illegal constructions in the city why the CMDA cannot be closed.

Division Bench Comprising Justices N.Kirubakaran and Krishnan Ramaswamy has expressed dissatisfaction over the function of CMDA and posed the question whether CMDA can be closed if it fails to stop illegal constructions. If the authority is unable to take action in accordance with law and show lenience why it should not be closed, the bench said.

Stating that day by day the encroachments and illegal constructions are increasing the bench said that the object of creation of CMDA itself failed. Even after the December 2015 floods the CMDA and the corporation of Chennai did not learnt lessons.

While referring the rainfall on Wednesday the bench said water logged on the roads even for the small rainfall and authorities have not cleared stagnant water.

The bench then directed the member secretary, CMDA and the Commissioner of Corporation of Chennai to appear before it on July 16, 2018 and explain over the issue.
