No stay on eviction from prime plot

Revenue says man has no right on prime 2,000 sq. yd. plot.

Hyderabad: The Hyderabad High Court on Tuesday refused to stay dispossession of a petitioner from a 2,000 sq. yd. plot on Road No. 12 in Banjara Hills of Hyderabad. Madhav K. Varakedkar, a resident of the city, moved the High Court challenging the action of the revenue authorities in evicting him from the plot. Counsel for the petitioner, arguing before Justice A. Rajasekhar Reddy, submitted that his client held the title over the land and this was recognised by earlier governments.

He said that his client purchased the land from certain individuals through registered sale deeds. Despite this, the authorities were now trying to dispossess his client from the land, counsel said. C.V. Bhaskar Reddy, counsel for the TS revenue department, told the court that the survey number being cited by petitioner was a nonexistent one and even the documents submitted by him were fabricated ones. Mr Bhaskar Reddy contended that plea of the petitioner was not maintainable and he has to prove his title by approaching the competent civil court and the High Court is not a forum to decide the title of the land. While refusing to grant interim relief, the judge directed counsel for revenue to file a counter affidavit.
