SHRC to cop: Compensate doc for harassment during arrest

Govt told to pay Rs 50,000 to doc, recover money from SI.

Chennai: The State Human Rights Commission has directed a policeman to pay a compensation of Rs 50,000 to an ophthalmologist in Viruthunagar district for harassing and humiliating him.

In the petition, Dr M. Rajendiran submitted that he was serving as ophthalmologist in government hospital, Vathirayiruppu, Virudhunagar district. On January 4, 2009, at about 7.30 am Subburam, sub-inspector (crime), Srivilliputhur police station forcefully entered into his house and shouted at him.

The cop refused to allow him to attend nature’s call and abused him in filthy language. He then dragged the doctor out from his house and took him to police station.

Dr Rajendiran was detained in the police station from 8 am to 2.45 p.m without giving water, food. He was not even allowed him to attend natural calls. He was remanded at prison. On the advice of the court, he was treated as in-patient in government hospital, Srivilliputhur. He was arrested without informing the reason. Hence he sought action against the cop.

In his reply, Subburam stated that the doctor was making false allegations. Sureshkumar of Sivakasi lodged a complaint against Rajendiran. The doctor had dispute with Sureshkumar over sale and purchase of the car. On direction from judicial magistrate, Srivilliputhur on January 4, 2009, a case under section 420 of IPC was registered against him and inspector ordered him to arrest the doctor and his wife. The cops had not uttered any words against him, Subburam said.
Judge D. Jayachandran said that denying a person of his liberty is a serious matter. Dr M. Rajendiran is not a rowdy and he was not involved offense like murder, decoity and robbery. And considering his status there is no possibility that he would abscond from the clutches of law. Police had not followed verdict of Supreme Court in D.K. Basu vs. state of West Bengal while making arrest.

The doctor was arrested and tortured. He suffered the humiliation at hands of the cop. The judge directed Subburam to pay '50,000 to the doctor. The judge directed the government to pay the compensation and recover the amount from the SI.
