Ban on use of living persons pics stays

Justice S. Vaidyanathan had passed an order on October 23 banning the use of pictures of living persons on digital banners and hoardings.

Chennai: The Madras high court has declined to stay the blanket ban on use of the pictures of living persons on digital banners and hoardings.

A division bench comprising Justices T.S. Sivagnanam and K. Ravichandrabaabu posted to December 18, further hearing of the appeal filed the Chennai Corporation, challenging the blanket ban imposed by a single judge.
Justice S. Vaidyanathan had passed an order on October 23 banning the use of pictures of living persons on digital banners and hoardings in an attempt to check the menace of illegal erection of banners.

The ban order was passed to maintain a clean atmosphere in the state and to avoid unnecessary drawings on the walls of buildings/residential places, the judge had added.

Contending that such a blanket ban would adversely affect the advertisement industry which primarily used pictures of models (living persons) on their digital banners and hoardings which were placed after obtaining due permission from the authorities concerned, the Chennai Corporation prayed that the court stay the operation of the ban order.
