AP Goverment files recall petition in Dharmabad court
Vijayawada: The Andhra Pradesh government on Thursday filed a recall petition in Dharmabad Court in Maharashtra in a case related to a protest by Chief Minister N. Chandrababu Naidu at Babli project site way back in 2010.
The recall petition is expected to come for hearing before the court on Friday and renowned advocate of Supreme Court Sandeep Luthra will be appearing on behalf of the Andhra Pradesh government.
This comes after the Dharmabad Judicial First-Class Magistrate N.R. Ghajbiye had rejected one such recall petition filed by the AP government on September 21 and insisted on Mr Naidu’s personal appea-rance.
In a serious observation, the Judge also rem-arked that the courts do not differentiate betwe-en a Chief Minister or a common man and all are equal before law.
The government had filed the recall petition after Dharmabad Judge had issued a non-bailable warrant (NBW) to Mr Naidu and few others in the case related to Babli protest.
After the recall petition was quashed by the Judge on September 21, government advocates sought time for Mr Naidu’s personal appearance.
Responding to the request, Dharmabad Court Judge had posted the case to October 15. Meanwhile, another recall petition has been filed on Thursday.
The case is related to a protest by Mr Naidu against the construction of Babli project in Maharashtra. Mr Naidu led an agitation in July 2010 and wanted to visit the Babli project site, across the border, stating that the project would affect those living downstream in the North Telangana region in the then united Andhra Pradesh.
