Hyderabad HC picks loopholes in Telangana's GO 123
Hyderabad: The Hyderabad High Court on Thursday made it clear that there was no clarity in the GO issued to rehabilitate affected families due to land procuring for establishing the National Investment and Manufacturing Zone in Medak district.
A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice U. Durga Prasad Rao was dealing with an appeal by the TS government challenging stay on GO 123.
A-G K. Ramakrishna Reddy placed GO 190, dated August 10, 2016 issued for providing compensation to agriculture labourers, artisans and particularly people from SC, ST and BC communities, working as labourers, who do not own any lands.
After perusing the GO, the bench pointed out that there was no mention in the GO about employment to the affected families. The bench sought to know whether the government has fixed '2,500 per month as annuity for 20 years based on the consumer price index or on other parameters.
The bench also pointed out that there was no definition with regard to the joint family and asked the A-G to file an affidavit by August 16 clarifying these doubts.
Earlier, while placing the GO before the bench, Mr Reddy submitted that the government has proposed to establish NIMZ in 12,600 acres and it expected several MNCs to come forward and establish their units in the NIMZ.
Won’t touch petitioners’ lands: Telangana
The TS government on Thursday assured the Hyderabad High Court that it will not touch the lands of those petitioners who have moved the High Court challenging procurement of lands for Mallannasagar Irrigation Project in Medak district through GO 123.
A-G K. Ramakrishna Reddy told the court that no state across the country was implementing the Land Acquisition, Rehabilitation and Resettlement Act, 2013.
He said if the petitioners’ land is required for the project, the government will acquire it through the Act, 2013.
A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice U. Durga Prasad Rao while hearing a batch of petitions challenging land procurement through GO 123 for the Mallannasagar recorded the statement of the AG.
The bench told the A-G to file an affidavit by August 22 explaining the details of procuring lands for the project. The bench reminded that the Act, 2013 will also be applicable to the submerged lands.
V. Venkataramana, senior counsel appearing for some of the petitioners, complained that the government was threatening those landowners who were not willing to sell their land under GO 123 and foisting police cases against them.
He placed the names of landowners who are facing police cases for refusing to sell their lands.
