Madras HC awards one week SI to Madurai Municipal corporation Commissioner
Chennai: The Madras high court has awarded simple imprisonment of one week to the Dr.Anies Sekar, Commissioner, Madurai Municipal Corporation, Madurai in connection with a contempt of court case.
Justice M.V.Muralidaran also imposed a fine of Rs 5,000 on the Madurai Municipal Corporation Commission, in default to undergo simple imprisonment for a further period of one week, for his willful disobedience of the order of the court dated October 24, 2016 and July 19 2018.
The judge was passing the order on a contempt petition filed by Vijayakumar, who contended that the order of the court to promote him on par with his juniors was not complied with by the authorities.
Originally, the government issued an order to prepare the interse seniority list containing the holders of the post of Revenue Assistants and Junior Assistants and on the basis of that list promotion panel has to be prepared and granted. One Ahamed Ibrahim challenged the same and a single judge of the high court upheld the G.O and directed the authorities to give promotion to Vijayakumar and three others.
The judge said from the seniority list this court can easily understand that the contemnor has preparing Inter-se-seniority list in the post of Assistant alone and they were not preparing Inter-se-seniority list among the Revenue Assistant and Junior Assistant as per the government letter which would clearly shows that the authority has not complied this court’s order in a proper manner. This court has given innumerable time to the Commissioner of Madurai Municipal Corporation and expecting that at least the contemnor should give respect to the order of this court by proving his bona fide. But, in this case the contemnor neither gives respect to this court nor given respect to the order of this court. Hence, this court hold that the contemnor has committed contempt for disobeying the order of this court, the judge added.
