Hyderabad High Court reserves order on house dissolution
Hyderabad: The Hyderabad High Court on Wednesday reserved its orders on petition seeking declare the action of the Governor in dissolving the Telangana Legislative Assembly on the advice of the Cabinet without ascertaining the views of the members of the House as unconstitutional.
Mr Niroop Reddy, senior counsel of the Supreme Court arguing for the petitioners before a division bench comprising Chief Justice Thottathil B. Radhakrishnan and Justice S.V. Bhatt submitted that the Governor dissolved the Assembly unconstitutionally.
He brought to the notice of the court that a committee with Governors of Five states has been constituted to frame the guidelines with regard to powers of Governors and also the Governors to act independently and the Governor for Telangana also a member in that committee.
He submitted that the Governor who is a member in that committee taken a decision without looking into the resolution of the Cabinet and without using his discretion and the act of the Governor was contrary to the provisions of the Constitution.
