Hyderabad: Saying that it did not find any illegality in the orders issued by Telangana Legislative Council chairman disqualifying two MLCs, Mr Yadava Reddy and Mr Sabavat Ramulu Naik, the Telangana High Court dismissed their petitions seeking relief from the court.
A division bench comprising Chief Justice Raghavendra Singh Chauhan and Justice Shameem Akt-her said that the petitions of the two disqualified MLCs were devoid of merits to prove that the chairman was biased.
The court asked the Election Commission to wait till July 15 for the issue of election notification to the two seats. This followed a request of counsel of the petitioners who said that the petitioners would like to move the Supreme Court on this judgement and apprehended that if the notification was issued immediately by the EC, the petitioners will be affected.
The bench asked the EC counsel how long it could wait to issue a notification. EC counsel Avinash Desai said that there was no procedure to wait to issue the notification. The EC had not issued the notification to the two seats due to the plea.
Mr Yadava Reddy, Mr Ramulu Naik, and Mr Bhoopathi Reddy were declared disqualified as MLCs on the ground of defection to the Congress from the TRS on orders passed by the Council chairman on January 16. They approached the HC individually.
On Wednesday, it pronounced its judgemen-ts only on the petitions of MrYadava Reddy and Mr Ramulu Naik.
In his petition, Mr Bhoopathi Reddy had challenged the validity of Para 8 in the Tenth Schedule of the Constitution.
