HMDA deal with Agile Securities set aside by High Court

Hyderabad: Hyderabad High Court has set aside the contract awarded by Hyderabad Metropolitan Development Authority (HMDA) to Agile Security Force Pvt. Ltd to provide integrated security services with manpower and security equipment at Buddha Pu-rnima project area in the city.

Justice M.S. Ramachandra Rao was allowing a petition by RSSS Pvt. Ltd challenging the action of the HMDA in awarding contract to Agile Security Force Pvt Ltd for providing in-tegrated security services at Lumbini Park, MR Gardens, Necklace Road and Sanjeevaiah Park for a period of three years.

The petitioner submitted that the HMDA awarded contract to the respondent company though it was disqualified as per the terms of the tender document and remarks submitted by the Tender Committee.

It was also submitted that as per the tender terms, the bidding companies have five years’ experience in providing CCTV/Door Frame Metal Detector facility (DFMD) but the respondent company had only experience in providing CCTV and DFMD facilities to the University of Hyderabad, during its convocation.

The respondent company co-ntended that after noticing the mistake in submitting the experience certificate, it had submitted the revised experience certificate as per the requirement in the tender conditions.

The Judge said that by merely providing DFMD facility or video recording of surveillance by its surveillance vehicle on one occasion, the respondent company cannot claim that it had five years’ experience in the required field.

The Judge held that even if the respondent company did not act mala fide, the award of contract of the subject work to it by the HMDA cannot be sustained.

While setting aside the award of contract, the Judge directed the HMDA and director, Buddha Purnima Project, to call for fresh tenders for the said work within four weeks from the date of receipt of a copy of this order.
