How did medical report land with Nalapad: Special Public Prosecutor
Bengaluru: How could Mohd Nalapad Haris, son of Shantinagar MLA N.A. Haris, accused of attempting to murder Vidwath could lay his hands on medical records of the victim, while the Investigating Officer (IO), despite repeated requests, was denied the same by the Hospital, argued Special Public Prosecutor Shyamsundar.
He highlighted that the same doctor had initially reported that the victim's injuries were of serious nature. He also informed the court that the police have issued notice to both Dr Anand and to the Hospital as there has been a case of manoeuvring and tampering with evidence in an attempt to dilute the case.
According to SPP, Dr Anand is the brother of a close associate of Mr Haris. He had allegedly signed the fabricated documents produced before the court that stated that Vidwath did not sustain grievous injuries.
The SPP pointed out that MLA Haris had posted the medical records on his Facebook account and tried to highlight his innocence on part of his son. The SPP said it remains a mystery as to how the petitioner's counsel obtained the medical records which was not provided to the patient as it is confidential. In a medico legal case, such information becomes even more confidential in nature.
It was submitted before the court that the victim's family is contemplating over approaching Karnataka Medical Council for a complete reexamination of Vidwath, while expressing no faith in Mallya Hospital. Earlier, senior advocate C.V. Nagesh, appearing for Nalapad, argued relying upon the medical documents that it is a simple case of drunken brawl and there are no grievous injuries.
He stressed that it was a case of malingering as the victim was intentionally delaying hospital discharge and stayed in ICU at the behest of parent’s request.
The SPP submitted a video footage obtained from the CCTV at Farzi Cafe and Mallya Hospital, to show the attack by Nalapad and his associates.
When the court asked if a bottle could be used as deadly weapon, Nagesh said that unbroken ones cannot cause or constitute as deadly weapon. Moreover, only bottles, jugs were used in the attack and it was a simple case of drunken brawl, he added. The SPP said that knuckle rings were used, which was mentioned in the complaint.
