Madras High Court quashes order detaining 5 in Kodanad case

Their representations were not considered by the detaining authority within the time frame stipulated in the rules.

Chennai: The Madras high court has set aside the orders of the Nilgiris District Collector, detaining five persons, who were allegedly involved in the murder of a watchman at Kodanad Estate of former chief minister J.Jayalalithaa, under the Goondas Act.

A division bench comprising Justices Rajiv Shakdher and N.Sathish Kumar allowed the Habeas corpus petitions filed by the family members of the accused, challenging the orders of the Nilgiris District Collector.

Their representations were not considered by the detaining authority within the time frame stipulated in the rules. This has vitiated their detention, the bench added and accordingly set aside the orders of the Collector, detaining them under the Goondas Act.
