He moved the then State Administrative Tribunal, which also dismissed his application.

Chennai: The Madras high court has ordered notice to the authorities on a petition questioning K. Kaliannan holding a post as director of industrial safety and health even after his superannuation.

On a petition from S. Paulvannam of Ashok Nagar, a retired selection grade superintendent in the office of the Inspector of Factories-Third Division came up for hearing, Justice SM Subramaniam passed the order and directed them to file replies in eight weeks.

According to petitioner, Kaliannan joined the services of the Directorate of Industrial Safety and Health, through the TN Public Service Commission as Assistant Inspector of Factories-II circle in March 1987.

After the limitation period of five years, he applied for change in his date of birth from May 25, 1959 to September 26, 1960. His pleas, however, were rejected by the higher ups thrice. He moved the then State Administrative Tribunal, which also dismissed his application.

However, suppressing facts relating to his age, he obtained an order in favour of him from Madras high court, in 2004.

Paulvannam said Kaliannan should have attained the age of superannuation by May 31 last. However, in view of the change in his date of birth, he continues in service and discharging the duties of the director from June 1 last in the full additional charge capacity.
