Palamuru GO cancelled after Hyderabad HC found defects
Hyderabad: The Telangana government on Monday informed the Hyderabad High Court that it would withdraw a notification issued to acquire lands for Vattem Balancing Reservoir in Mahbubnagar district under the Palamuru-Ranga Reddy Lift Irrigation Scheme in view of the court pointing out several defects in the notification.
Justice Suresh Kumar was hearing a petition by K. Veeranandam and another from Vattem village in Mahabubnagar district questioning the notification issue for land acquisition.
When this petition came up for hearing, the court found fault with the government for issuing an incomplete notification, having several unfilled blanks to acquire lands. The court also cautioned that it will strike down the notification if the authorities failed to rectify the defects.
While the notification has a reference to Ga-zette, it does not give the date of publication of Gazette. The petitioners questioned the notification issued under section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilita-tion and Resettlement Act, 2013 and contended that it is arbitrary.
While submitting that the petitioners are opposed to the construction of irrigation project, they said that the law mandates consultation with gram sabha, updation of market value of lands befo-re the initiation of land acquisition process.
