Hyderabad High Court refuses Telangana plea for stay on NGT's panel
Hyderabad: The Hyderabad High Court on Thursday expresses its disinclination to stay an order granted by the National Green Tribunal at Chennai, constituting an independent commission to ascertain whether the ongoing Ranga Reddy-Palamuru lift irrigation scheme works under the first phase are for the purpose of drinking water or for irrigation.
A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice T. Rajani was dealing with an appeal by the TS government challenging the decision of the Tribunal to constitute the panels.
TS AA-G J. Ramachandra Rao contended that the tribunal cannot pass the order in the absence of an expert member on its bench.
The HC bench said that it unable to understand why the government objecting to constitution of the independent panel since it was only a fact-finding commission.
The AA-G said that the state was not objecting to the constitution of the panel, it was only pointing out that the Tribunal has not followed due procedure of law and the order was passed in the absence of an expert committee member in the bench.
When he sought a stay on the order of the tribunal, the HC bench made it clear that it will not grant any interim orders without hearing the petitioner.
