Telangana government prepares defence for Supreme Court
Hyderabad: The TS government is going to submit before the Supreme Court that it will allot waters to controversial Palamuru-Rangareddy and Dindi projects from its rightful share and that taking up construction of these projects would in no way impact other states. The government will also claim that the projects are pending projects sanctioned by the previous united AP government.
A few farmers from Krishna Delta region have filed a SLP before the Supreme Court seeking a stop to the construction of these two projects claiming they would stop supplies from Srisailam dam which reaches them.
The Supreme Court has issued notices to both TS and AP and to the Union government directing them to file affidavits. Accordingly, the TS irrigation department has started preparing a detailed affidavit which will be filed in SC after the vacation.
“We are going to state that there was no separate allocation of Krishna waters to TS as is being claimed after bifurcation,” said C. Muralidhar, Engineer-in-Chief.
He said since both these projects were given approvals by the previous united AP government, they cannot be construed as new projects and should be considered as ongoing projects.
Meanwhile, the Brijesh Kumar Tribunal will resume hearing the arguments by both TS and AP starting from Monday for three days. The extended Tribunal will have to decide whether its functioning is limited to four states — AP, TS, Karnataka and Maharastra or to only the two residuary states.
“The Tribunal’s decision on this main issue and the pending case in the SC will decide the allocation of Krishna waters to TS, then only would TS allot waters to various projects within its territory including the Palamuru-Rangareddy and Dindi,” said TS irrigation inter-state affairs chief engineer M. Narasimha Rao.
