Chennai: Insurance firm directed to pay Rs 7.94 lakh to kin of road mishap's victim

They were thrown off the bike and sustained grievous injuries. Jayachitra succumbed to injuries.

Chennai: The Motor Accident Claims Tribunal, Chennai, has directed a private insurance firm to pay Rs 7.94 lakh to family of a 40-year old woman who died in a road accident.

Special judge, special sub court-I, M.A. Kabeer, directed Reliance General Insurance Co. Ltd to pay the sum with 7.5 per cent interest. The petitioners, R. Viswanathan, a differently-abled, and other family members, belonging to Ambedkar Nagar, Tambaram, submitted that Viswanathan was going to Padappai from Vandalur on a two-wheeler on January 27, 2010. He was accompanied by his wife Jayachitra and a maid servant on the pillion. A lorry driven in a rash and negligent manner in the opposite direction dashed against the bike near Kara Sangal old cinema theatre.

They were thrown off the bike and sustained grievous injuries. Jayachitra succumbed to injuries. The petitioners said the lorry owner of Anakaputhur and insurer of the vehicle were liable to pay compensation to the family members.

The insurance firm said the accident occurred only due to the reckless act of Viswanathan, who rode the bike without observing rules. After filing counter, the insurance firm did not participate in subsequent proceedings. Hence, the firm was set as ex-parte. The tribunal held the accident occurred due to driver’s negligence.
