Plea to invalidate Jaya victory dismissed by Madras HC

In her petition, Pravina submitted that she contested as independent candidate in R.K.Nagar constituency.

Chennai: The Madras high court on Wednesday dismissed as abated, the election petition, challenging the election of late former chief minister J.Jayalalithaa from R.K.Nagar assembly constituency during the May 2016 state assembly elections.

Justice M.Duraiswamy dismissed as abated, the election petition filed by an independent candidate G.Pravina, after counsel for Jayalalithaa informed the court about the death of Jayalalithaa.

In her petition, Pravina submitted that she contested as independent candidate in R.K.Nagar constituency. The RO had not given permission to her for campaigning and using vehicles in the constituency.

The vehicles used by her were detained at gun point by the police. The POT symbol was not as per the specification of the Election Commission of India.

Though the CEO assured that action will be taken, no such action was taken on her complaint to stop the election or to postpone the election. By not acting on her complaints, her right to equality enshrined under Article 14 of the Constitution was affected, she added and sought to declare the election as null and void and to conduct fresh poll.
